Medical Cannabis Provider Denied Advertising on City Transit

City of Albuquerque cites funding concerns for denying advertising to state-licensed business

(Albuquerque) – Ultra Health, New Mexico’s #1 Cannabis Company, has been denied the opportunity to advertise on the ABQ Ride Buses due to concerns about losing federal funding.

Ultra Health is one of the 35 medical cannabis providers licensed by the New Mexico Department of Health, and its operations are completely legal under the Lynn and Erin Compassionate Use Act.

In a letter sent September 13, the city’s legal counsel believed it would lose federal grants which are used to fund ABQ Ride Buses because it is illegal on the federal level to advertise a Schedule I substance.

In response to the city’s letter, City Councilman Pat Davis sent the Federal Transit Administration a letter asking for clarification on the legality of advertising medical cannabis in New Mexico as it is legal pursuant to state law.

“I believe that the patients who rely on medical cannabis to treat their debilitating medical conditions will benefit from the goods and services of licensed producers being advertised,” Councilman Davis states in the letter. “Competition in the marketplace is to be encouraged, and advertising is part of encouraging a thriving market will emerge in New Mexico.”

The provider’s submitted advertising design does not violate any of the transit agency’s policies or contain any cannabis imagery.

Currently, the ABQ Ride Bus Advertising policy states advertising content will not be displayed that:

  • Is false, misleading, or deceptive,
  • Relates to an illegal or unlawful activity,
  • Advertises alcohol or tobacco products,
  • Depicts violence and/or anti-social behavior, or
  • Includes language, which is obscene, vulgar, profane and scatological.

Ultra Health submitted bus design

In 2016, The San Francisco Municipal Transportation Agency allowed a cannabis campaign to advertise on its buses. The agency is federally funded and did not report losing grants due to the campaign.

It is unknown whether any other transit agency or organization has lost federal funding by allowing state-licensed and legally operating cannabis business to advertise their service or products.


Ultra Health Opens Eighth Location, Now in Six N.M. Counties

New Mexico provider becomes nation’s largest vertically integrated medical cannabis network

(Alamogordo) – Ultra Health, New Mexico’s #1 medical cannabis company, will officially open its eighth location in Alamogordo, N.M., on Tuesday, August 29. The eighth location will also make Ultra Health the nation’s largest vertically integrated, seed-to-sale medical cannabis network in the country.

 

The opening comes after a long-awaited inspection from the New Mexico Department of Health (NMDOH). Ultra Health initially submitted its amendment to open a dispensary in Alamogordo in May of 2016. There are currently more than 45,000 enrollees in the state’s medical cannabis program.

New Mexico Medical Cannabis Providers Pay $2.93 Million for 14,550 Plants

Licensed plants increased by 5%, patient enrollment projected to be up 150% for same period

New Mexico Medical Cannabis Provider Hits Millionth Gram Milestone

Patient given free medicine for one year for buying Ultra Health’s millionth gram of flower

(Albuquerque) – Ultra Health, New Mexico’s No. 1 cannabis company with a nationwide presence, is celebrating its millionth gram of cannabis flower sold in New Mexico by providing one patient with free medicine for one full year.

New Mexico Medical Cannabis Program Sees Record Patient Growth

Patient enrollment continues exponential growth; plants and revenues lag behind

(Albuquerque) – The New Mexico Medical Cannabis Program’s patient enrollment has seen its fastest growth yet, climbing by 15,357 patients or 53 percent in the first six months alone of 2017. The 44,403 current program enrollment is on track to increase by an annualized rate of 103 percent, to nearly 60,000 patients by December 31, 2017.

Ultra Health Files Freedom of Speech Lawsuit

Federal suit filed against EXPO New Mexico officials under First and Fourteenth Amendments

 

(Albuquerque) – New Mexico Top Organics-Ultra Health filed a complaint against three EXPO New Mexico officials for unconstitutional attempts to limit the company’s rights to display a cannabis educational and informative booth at the New Mexico State Fair in 2017.

 

Because EXPO New Mexico is a government entity and the New Mexico State Fair a public forum, restricting Ultra Health’s ability to educate the public and advocate on behalf of medical cannabis violates the First and Fourteenth Amendments, the lawsuit contends.

New Mexico Medical Cannabis Program Surpasses 40,000 Patients

Patient enrollment sees biggest reported month to month jump in program history

(Albuquerque) – The Medical Cannabis Program’s patient enrollment reached 40,432 patients as of April 30, 2017, an increase of more than 5,500 patients since March according to the New Mexico Department of Health (NMDOH). The program is on track to enroll nearly 60,000 patients by the end of 2017.

March to April was the biggest month to month increase the program has seen since its inception in 2007. The number of patients enrolled in the program has increased by 84 percent since March 31, 2016 (NMDOH did not issue a patient statistics report for the month of April 2016). First quarter revenues in 2017 reached $19 million, with year-end revenues expected to reach $83.5 million.

New Mexico Medical Cannabis Sales Soar 86 Percent in First Quarter

Ultra Health remains New Mexico’s #1 medical cannabis provider for 2017

 

(Albuquerque) – The Medical Cannabis Program’s revenues from the first quarter of 2017 reached $19 million, a whopping 86 percent increase over the first quarter of 2016 according to quarterly reports released by the New Mexico Department of Health.

 

While the growth rate was 64 percent from 2015 to 2016, the growth rate has accelerated dramatically in the 2017 first quarter. New Mexico Judge Grants Stay to Halt NMDOH Proposed Sanction

Ruling allows Ultra Health’s seven locations to remain open during year’s biggest sales week

 

(Santa Fe) – Santa Fe District Judge David K. Thomson granted Ultra Health a stay Monday from the New Mexico Department of Health (NMDOH) proposed sanction for bringing Dorothy, a 3-week-old cannabis seedling, to the New Mexico State Fair on September 8, 2016.

 

“[The] Court finds that the Petitioner [Ultra Health] will likely prevail on the merits of their arguments that the sanction imposed is excessive and without much support in law or regulation,” Judge Thomson said in his order.

 

The judge ordered a motion to stay the sanction of ceasing Ultra Health’s operations for five consecutive days and that Ultra Health must still pay the proposed $100 fine.
